Terms & Conditions for £20 Deposit Reservation

1. Introduction

These Terms & Conditions ("T&Cs") apply to customers placing a £20 deposit to reserve their pair of Tzuka earbuds. By making a deposit, you agree to the terms outlined below.

“Order completion” refers to the process where a customer has paid the remaining balance of the full purchase price after the initial deposit, and the order has been confirmed by Tzuka Ltd.

3. Deposit Terms

• The £20 deposit is deductible from the final price of the earbuds.
• The deposit is refundable only if Tzuka Ltd is unable to fulfill orders before December 31st 2025.
• Customers must complete their purchase within 7 days of being notified that orders are ready for completion. If the purchase is not completed within this period, the reserved earbuds will be released for sale to other customers, and the deposit will be forfeited.

4. Product & Fulfillment

• Estimated fulfilment and shipping of the Tzuka earbuds is before October 31st 2025.

• If any changes to the final product specifications occur, customers will be notified via email. If they do not wish to proceed with their reservation due to these changes, they may request a refund.
• Customers who place a deposit are guaranteed a pair of earbuds, subject to successful order completion of the final purchase within the required time.
• Customers may reserve multiple pairs upfront.

5. Promotional T-Shirt Offer for Early Adopters

• Customers will receive a complimentary Tzuka t-shirt as part of the early adopter launch promotion, subject to availability.
• T-shirt sizing options will be provided at the point of order completion.
• If a customer’s preferred size is not listed, they may contact Tzuka at info@tzuka.com. While we will make reasonable efforts to accommodate such requests, we cannot guarantee availability outside of the listed sizes.
• We aim to dispatch the t-shirt together with the earbuds; however, Tzuka Ltd reserves the right to ship them separately at its discretion.
• Postage for the promotional t-shirt is free of charge.
• As the t-shirt is a complimentary gift, it is non-returnable and non-refundable.
• The t-shirt will only be issued once the order is completed and full payment has been received.
• This promotional item is subject to availability. Tzuka Ltd reserves the right to withhold the t-shirt or substitute it with an item of equal value, at its sole discretion, should stock be unavailable.

6. Payment & Refunds

• Accepted payment methods for the deposit: Mastercard and Visa Credit/Debit Card, Apple Pay, Google Pay.
• If a customer qualifies for a refund under these T&Cs, the refund will be processed within ten (10) business days.
• If fulfilment of the product is delayed beyond December 31st 2025, customers will have the option to request a refund.

7. Cancellation & Modifications

• Deposits are non-refundable and non-transferable, except under the conditions explicitly stated in these T&Cs.
• Tzuka Ltd reserves the right to cancel a customer's reservation and/or deposit at its discretion.

8. Shipping & Territorial Restrictions

• Customers worldwide can place a deposit to reserve their earbuds.
• Customers outside of the UK will be subject to additional shipping costs (refer to the Tzuka Shipping Policy for full details).
• Standard shipping within the UK is free, with express options available for an extra charge.

9. Liability & Disclaimers

• In the event of unexpected delays or changes in the product, Tzuka Ltd will notify customers, who will then have the option to request a refund.
• If an oversubscription occurs due to an accidental error, affected customers will be contacted and fully refunded.
• Tzuka Ltd is not liable for any indirect, incidental, or consequential damages arising from the delay or modification of the product.

10. Data Protection

• Tzuka Ltd is committed to protecting customer data and will only use personal information provided during the deposit process in accordance with its Privacy Policy.
• Customer data will not be shared with third parties except as required to process payments and fulfill orders.

11. Dispute Resolution

• Any disputes arising from these T&Cs should first be addressed by contacting Tzuka Ltd at info@tzuka.com.

• If a resolution cannot be reached, disputes will be handled in accordance with the governing law specified below.

12. Governing Law

• These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.
• Any legal disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Force Majeure

• Tzuka Ltd shall not be held liable for any failure or delay in fulfilling orders due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war, government regulations, supply chain disruptions, or other force majeure events.
• In the event of a force majeure event, customers will be notified, and affected orders may be delayed or canceled with a full refund.
