TERMS OF
USE
Effective date: 10 August, 2026
These Terms of Use govern your use of www.tzuka.com (the "Site"). The Site is operated by Tzuka Limited, The Studio, Holywell Building, Holywell Way, Loughborough, LE11 3UZ, United Kingdom, registered in England and Wales under company number 11059456 ("Tzuka", "we", "us").
Nothing in these terms limits or excludes your rights as a consumer. Where anything here appears to conflict with your statutory rights, your statutory rights apply.
1. About These Terms
These terms cover browsing and using the Site. They are not the terms on which we sell you anything — those are separate, and are set out in section 2.
By using the Site you accept these terms. If you do not accept them, please do not use the Site.
2. If You Are Buying From Us
Your purchase is governed by our Terms & Conditions for £20 Deposit Reservation, together with our Returns Policy, Shipping Policy and Two-Year Limited Warranty. Those documents, not this page, set out what you are buying, what you pay, when it arrives and how to cancel or return it.
If anything on this page conflicts with those documents in relation to a purchase, those documents take precedence.
3. Using the Site
We ask you not to:
- copy, republish or commercially exploit the content of the Site without our permission;
- upload or send anything unlawful, defamatory, obscene, or infringing someone else's rights;
- introduce viruses or other malicious code, or attempt to gain unauthorised access to the Site or the systems behind it; or
- use automated systems to scrape or overload the Site.
Beyond that, the Site is yours to browse. Once you own a pair of TZ7 Ultra earbuds, they are yours — you are free to use, lend, give away or resell them, and nothing here restricts that.
4. Our Content and Yours
The text, images, video, designs, trade marks and software on the Site belong to Tzuka or our licensors. We grant you permission to view and use the Site for your own personal use.
If you send us a review, photograph, suggestion or other content, you keep ownership of it. You give us permission to use it to promote Tzuka and our products, across our website and marketing channels. You can withdraw that permission at any time by emailing info@tzuka.com, and we will stop using it going forward, though we may not be able to recall material already printed or published. Please only send us content that is yours to share.
We may remove content from the Site where we reasonably consider it unlawful, offensive, or not ours to display.
5. Accuracy of Information
We take care to keep the Site accurate and up to date, and we correct errors when we find them. Content on the Site is general information, not professional advice.
Training and performance content is provided for general interest. It is not medical advice — if you have a health condition or an injury, please speak to a qualified professional before changing how you train.
Product descriptions, specifications and images are as accurate as we can make them. Where a product specification changes materially before your order is dispatched, your rights are set out in our Deposit Reservation Terms.
6. Privacy and Cookies
Our Privacy Policy explains what personal information we collect and what we do with it. Our Cookie Policy explains what cookies we use and how you control them. Apart from cookies that are strictly necessary, we do not set any without your consent.
7. Your Warranty and Statutory Rights
Tzuka-branded hardware comes with a two-year limited warranty running from the date the product is delivered to you. It is a voluntary commercial guarantee offered in addition to your rights under consumer law, and it does not replace or limit them. Full details, including what is covered and how to claim, are in our Two-Year Limited Warranty.
Separately, and whatever the warranty says, goods we sell you must be of satisfactory quality, fit for purpose and as described under the Consumer Rights Act 2015. You generally have 30 days from delivery to reject faulty goods for a full refund, and rights to repair or replacement after that. Distance purchases also carry a 14-day cancellation right under the Consumer Contracts Regulations 2013, explained in our Returns Policy.
8. Safety Information
Please read our Safety Information before using your earbuds, particularly the guidance on listening volume and on awareness of your surroundings when training outdoors.
9. Where We Sell
The Site can be viewed from anywhere, but we currently sell and deliver to United Kingdom addresses only. We intend to open other territories once we hold the certifications and approvals required in those markets.
If you placed a reservation from outside the United Kingdom before 10 August 2026, your reservation stands and is governed by a separate Legacy International Reservation Notice issued to you directly. Nothing on this page cancels or reduces the rights set out in that notice.
10. Our Liability to You
We do not exclude or limit any liability that cannot lawfully be excluded or limited. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for your statutory rights in relation to goods that are faulty, not as described or not fit for purpose.
Subject to that, we are not responsible for losses that were not foreseeable when you started using the Site, or for business losses — the Site is provided for personal use.
We aim to keep the Site available, but we do not guarantee it will be uninterrupted or error-free, and we may suspend it for maintenance.
11. Suspending Access to the Site
We may restrict or suspend access to the Site where we reasonably believe someone is using it unlawfully, attempting to compromise it, or in serious breach of section 3. Where it is practical and appropriate to do so, we will tell you why.
Suspending access to the Site does not affect any order you have already placed, any reservation you hold, or any of your rights under the documents listed in section 2.
12. Changes to These Terms
We may update these terms from time to time. The version that applies is the one published on the Site when you use it, and the effective date at the top tells you when it last changed.
Changes to these Terms of Use do not change the terms of an order or reservation you have already placed. How those may be varied is set out in clause 15 of our Deposit Reservation Terms.
13. Governing Law
If you live in England or Wales, these terms are governed by the law of England and Wales, and you may bring legal proceedings in the courts of England and Wales.
If you live in Scotland, these terms are governed by Scots law, and you may bring legal proceedings in the Scottish courts.
If you live in Northern Ireland, these terms are governed by Northern Irish law, and you may bring legal proceedings in the Northern Irish courts.
Nothing in this section affects any mandatory right you have to bring proceedings in the courts of the part of the United Kingdom in which you are domiciled.
