TERMS & CONDITIONS FOR £20 DEPOSIT
RESERVATION
Effective date: 10 August, 2026
1. Introduction
These Terms & Conditions ("T&Cs") apply to customers placing a £20 deposit to reserve their pair of Tzuka earbuds. By making a deposit, you agree to the terms outlined below.
"Order completion" refers to the process where a customer has paid the remaining balance of the full purchase price after the initial deposit, and the order has been confirmed by Tzuka Ltd.
2. Company Information
Company Name: Tzuka Limited
Registered Address: The Studio, Holywell Building, Holywell Way, Loughborough, LE11 3UZ, United Kingdom
3. Deposit Terms
- The total early adopter price is £190 including VAT. You pay £20 today as a deposit, and the remaining balance of £170 when your order is ready. There is nothing else to pay, and UK delivery is free.
- The £20 deposit reserves your place in the first production batch and is deducted in full from the total price.
- You can cancel your reservation and get your £20 back in full at any time before you pay the balance, for any reason. Email info@tzuka.com and we will refund to your original payment method within five (5) working days. You do not need to give us a reason.
- When your batch is ready we will email you a link to complete your purchase at your early adopter price. We will email you again three days later as a reminder. You will have fourteen (14) days from the first notification to complete.
- If you do not complete within fourteen days, we will release your place to another customer and refund your £20 deposit in full. You will not lose your deposit for missing the window.
- Your early adopter price of £190 including VAT is locked from the moment you reserve and does not change, whatever the retail price is at launch.
4. Product & Fulfilment
- We are currently targeting November–December 2026 for dispatch of the first batch. This is our working estimate, not a guarantee. We are a small British manufacturer and dates can move; if ours does, we will email you, tell you why, and offer you a full refund if you would rather not wait.
- Our committed backstop is 31 December 2026 for dispatch. If we have not dispatched your order by that date, we will refund you in full, automatically. You will not need to contact us or ask.
- If you have already completed your purchase and we do not dispatch by the backstop date, we will automatically refund all amounts paid by you, including both the £20 deposit and the £170 remaining balance.
- Once dispatched, standard UK delivery is typically 3–4 business days. Full details are in our Shipping Policy.
- If the final product specification changes in any material way, we will notify you by email. If you do not wish to proceed on the revised specification, you may request a full refund of all amounts you have paid.
- Customers who place a deposit are guaranteed a pair of earbuds from the first batch, subject to completing their purchase within the fourteen-day window.
- You may hold a maximum of six live reservations at any one time. This is a limit per customer, counted across all of your orders, email addresses and payment methods, and across every channel through which you order. We will not accept further £20 reservation deposits from you above that limit. If you would like a larger quantity, contact us at info@tzuka.com and we will arrange it on different terms, without taking additional reservation deposits.
5. Promotional T-Shirt Offer for Early Adopters
- Customers who complete their purchase will receive a complimentary Tzuka t-shirt as part of the early adopter launch promotion, while stocks last.
- T-shirt sizing options will be provided at the point of order completion.
- If a customer's preferred size is not listed, they may contact Tzuka at info@tzuka.com. While we will make reasonable efforts to accommodate such requests, we cannot guarantee availability outside of the listed sizes.
- We aim to dispatch the t-shirt together with the earbuds; however, we may ship them separately.
- Postage for the promotional t-shirt is free of charge.
- The t-shirt is a genuine free gift. If you cancel your completed purchase and return your earbuds, we would appreciate the t-shirt back where practical, but you will not be charged for it and your refund will not be reduced if you keep it.
- The t-shirt will only be issued once the order is completed and full payment has been received.
6. Price, Payment & Refunds
- Total price: £190 including VAT. Payable as £20 now and a £170 balance on order completion. UK delivery is free; express delivery options are available at additional cost.
- Accepted payment methods for the deposit: Visa, Mastercard, American Express and Diners Club credit and debit cards, Apple Pay, Google Pay, Revolut Pay, and Link.
- Reservation refunds made before order completion are processed to your original payment method within five (5) working days of your request.
- Refunds following cancellation of a completed purchase are processed in accordance with our Returns Policy.
- If we do not dispatch by 31 December 2026, refunds of all amounts you have paid are issued automatically without any action from you.
7. Cancellation & Modifications
- You may cancel your reservation at any time before paying the balance and receive a full refund of your deposit, as set out in clause 3.
- After you have completed your purchase, your statutory cancellation rights apply as set out in clause 16. If you cancel because you have changed your mind, you bear the direct cost of returning the earbuds. If you choose to use our prepaid returns label, we will deduct its £4.95 direct postage cost from your refund. You are free to arrange and pay for your own return instead. If the earbuds are faulty or not as described, we cover the return cost in full.
- Reservations are not transferable to another person.
- We may cancel a reservation only where: (a) the payment was fraudulent or is subject to a chargeback; (b) the reservation was created in error or duplicated; or (c) we are unable to lawfully supply the product to your delivery address. In every one of these cases we refund all amounts you have paid, in full.
8. Delivery Territory
- New deposits are currently available only to customers with a United Kingdom delivery address.
- Standard shipping within the UK is free, with express options available for an extra charge. Full details are in our Shipping Policy.
- We intend to open reservations to other territories once we have obtained the certifications and approvals required in those markets. If you are outside the UK and would like to be notified when we do, please contact info@tzuka.com.
If you placed a reservation from outside the United Kingdom before 10 August 2026, your reservation stands and is governed by a separate Legacy International Reservation Notice issued to you directly. Nothing in these T&Cs cancels or reduces the rights set out in that notice.
9. Liability & Disclaimers
- Nothing in these terms limits or excludes any liability which cannot lawfully be limited or excluded, including your statutory rights in relation to goods that are faulty, not as described, or otherwise do not conform to the contract.
- In the event of unexpected delays or changes in the product, Tzuka Ltd will notify customers, who will then have the option to request a full refund of all amounts paid.
- If an oversubscription occurs due to an accidental error, affected customers will be contacted and fully refunded.
- Subject to the above, Tzuka Ltd is not liable for any indirect or consequential loss arising from delay to, or modification of, the product.
10. Data Protection
Personal data provided during the deposit and order process will be processed in accordance with our Privacy Policy, which sets out what we collect, why, who we share it with, and your rights. For any data-related enquiries, contact info@tzuka.com.
11. Dispute Resolution
Any disputes arising from these T&Cs should first be addressed by contacting Tzuka Ltd at info@tzuka.com. We aim to resolve complaints quickly and fairly.
If a resolution cannot be reached, you remain free to bring a claim as set out in clause 12. Nothing in this clause prevents you from exercising your legal rights at any time.
12. Governing Law
If you live in England or Wales, these Terms & Conditions are governed by the law of England and Wales, and you may bring legal proceedings in the courts of England and Wales.
If you live in Scotland, these Terms & Conditions are governed by Scots law, and you may bring legal proceedings in the Scottish courts.
If you live in Northern Ireland, these Terms & Conditions are governed by Northern Irish law, and you may bring legal proceedings in the Northern Irish courts.
Nothing in this clause affects any mandatory rights you have to bring proceedings in the courts of the part of the United Kingdom in which you are domiciled.
13. Force Majeure
Tzuka Ltd shall not be held liable for any failure or delay in fulfilling orders due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war, government regulations, supply chain disruptions, or other force majeure events.
In the event of a force majeure event, customers will be notified, and affected orders may be delayed or cancelled with a full refund of all amounts paid.
For the avoidance of doubt, the 31 December 2026 dispatch backstop in clause 4 continues to apply notwithstanding this clause.
14. Contact Information
For any inquiries regarding these Terms & Conditions, please contact info@tzuka.com.
15. Amendments
- Any changes we make to these T&Cs apply to future reservations only.
- We may apply a change to an existing reservation only where the change is required by law or regulation, or where the change is entirely to your benefit.
- If we need to make any other material change affecting your existing reservation, we will contact you. That change will only take effect with your agreement, and if you do not agree you may cancel and receive a full refund of all amounts you have paid.
16. Your Statutory Rights
These terms do not affect your statutory rights. Where you are a consumer contracting at a distance, you have rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015. Nothing in these terms limits or excludes those rights.
Cancelling your completed purchase. You may cancel your completed purchase from the date the sales contract is formed until 14 days after the day you receive the earbuds. If you cancel after receiving them, you then have a further 14 days from the day you notify us of your cancellation to return them to us. To cancel, email info@tzuka.com, or use the model cancellation form in our Returns Policy. You do not have to use the form.
Faulty or misdescribed goods. If your earbuds are faulty, not as described, or do not conform to the contract, you have rights under the Consumer Rights Act 2015 which are separate from, and additional to, the cancellation rights above. These include a right to reject within 30 days of delivery, and rights to repair or replacement after that period.
Our warranty is additional. Our two-year limited warranty is a voluntary commercial guarantee offered in addition to your statutory rights. It does not replace them, and it does not limit them in any way.
