Two-Year Limited Warranty
Effective date: 14 May, 2025
This Tzuka Two-Year Limited Warranty is a voluntary manufacturer’s warranty that provides rights in addition to those granted under applicable consumer law. It does not exclude, limit, or suspend your rights under consumer law, including but not limited to rights relating to non-conforming goods. As such, you may choose to claim service under this warranty or through your consumer law rights. To activate the warranty, you must register your product in the Tzuka app. This warranty is applicable to the original registered owner only, and cannot be transferred to another owner.
Scope of Warranty
Tzuka warrants that your Tzuka-branded hardware product (“Product”) is free from defects in materials and workmanship for a period of TWO (2) YEARS from the date of original retail purchase (“Warranty Period”) when used in accordance with Tzuka’s user guidelines. Under this warranty, you may direct claims to Tzuka even if the Product was purchased from a third-party retailer.
If a defect arises during the Warranty Period, Tzuka, at its sole discretion, will do one of the following:
- Repair the Product at no charge using new or refurbished genuine Tzuka parts.
- Exchange the Product for a replacement of the same model.
- Refund the original purchase price of the Product.
Exclusions and Limitations
This warranty does not cover:
● Normal wear and tear, including battery degradation unless due to a defect in materials or workmanship.
● Damage caused by accidents, abuse, neglect, misuse, improper maintenance, or modifications.
● Damage resulting from unauthorised repairs or service.
● Cosmetic damage, including scratches and dents, that do not affect the functionality of the Product.
Tzuka does not guarantee that it will be able to repair or replace any Product without risk of loss of data. Under no circumstances shall Tzuka be liable for: (a) Loss or damage that is not foreseeable at the time of purchase; (b) Losses resulting from user negligence, loss of data/stored audio, or loss of profits.
Limitations of Liability
Any limitation of liability outlined in this warranty does not apply to: (i) Death or personal injury caused by defective products; (ii) Fraud or fraudulent misrepresentation; (iii) Gross negligence or intentional misconduct; (iv) Breaches of major contractual obligations.
Obtaining Warranty Service
To obtain warranty service, contact Tzuka using the details provided at www.tzuka.com/support. Proof of purchase may be required. Tzuka will provide you with an address to post your defective products to. The cost of this is the responsibility of the customer.
Service options may vary by country, and additional charges may apply for international service requests. Tzuka may use replacement products or parts sourced from a different country, provided they meet local standards.
Regional Consumer Law Rights
This warranty is provided in addition to, and does not limit, your statutory rights under applicable consumer laws:
United Kingdom & Ireland
Consumers are protected under the Sale of Goods Act 1979 (UK), Supply of Goods and Services Act 1982 (UK), Sale of Goods Act 1893 (Ireland), Sale of Goods and Supply of Services Act 1980 (Ireland), and the European Communities (Certain Aspects of the Sale of Consumer Goods and Associated Guarantees) Regulations 2003 (Ireland).
European Union
Consumers have rights under the Consumer Sales and Guarantees Directive (1999/44/EC) and the Omnibus Directive (EU) 2019/2161, ensuring products conform to contract and are free from defects.
United States
This warranty is provided in addition to rights under the Magnuson-Moss Warranty Act. Additional protections may apply under state laws.
Australia
Goods are covered by guarantees under the Competition and Consumer Act 2010 (Australian Consumer Law). Consumers are entitled to a replacement, refund, or compensation for major failures. Repairs may result in data loss.
New Zealand
Covered by the Consumer Guarantees Act 1993. Consumers are entitled to repairs, replacements, refunds, or compensation based on the nature of the failure. Repairs may result in data loss.
Canada
Quebec residents are protected under provincial consumer protection legislation.
This warranty does not exclude or limit rights provided by consumer law.
Severability and Governing Law
If any term in this warranty is found to be unlawful or unenforceable, the remaining terms shall remain in full effect. This warranty is governed by the laws of the UK.
